Definitions
Coach means Ann Desseyn - Cooper, Life & Business Coach, Gaelic Tutor, Director
GDPR means the General Data Protection Regulation.
Responsible Person means Ann Desseyn - Cooper, Life & Business Coach, Gaelic Tutor, Director
Register of Systems means Wix E-mail Subscription and Member Contact list.
Content means - electronic and printed materials, courses, marketing materials

By signing up for our services, you agree to comply with and be bound by these Terms and Conditions. In order to use our services, you must be at least 18 years old and have the necessary authority to agree to these Terms and Conditions.

Persons under 18 are prohibited from using our services. We reserve the rigth to modify any information provided, regardless of its source (content), without prior notice. We do not guarantee that all content is accurate, complete, reliable, current, or error-free. Love Gàidhlig Ltd assumes no liability for any inaccuracies, errors, or ommissions in the content.

Love Gàidhlig Ltd is domiced in the UK. Content may not be appropriate or legal outside Scotland/UK. If you access our site from outside the UK, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

1. Data protection principle
The Coach is committed to processing data in accordance with its responsibilities under the GDPR.
All site members and subsribers agree to receive e-mail marketing untill such a request is made to remove both site membership and subscription from the system.
The Coach is performing regulary checks of requests to unsubscribe and takes action accordingly to make sure both site membership and subscription are removed from the system. If you are a current student, we will not be able to remove you until you finish your course, as removing you from our list, also removes access to your course.
Article 5 of the GDPR requires that personal data shall be:

processed lawfully, fairly and in a transparent manner in relation to individuals;

collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes; further processing for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes shall not be considered to be incompatible with the initial purposes;

adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed;

accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay;

kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed; personal data may be stored for longer periods insofar as the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes subject to implementation of the appropriate technical and organisational measures required by the GDPR in order to safeguard the rights and freedoms of individuals; and

2. General provision

This policy applies to all personal data processed by the Coach.

The Responsible Person shall take responsibility for ongoing compliance with this policy.

This policy shall be reviewed at least annually.
3. Lawful, fair and transparent processing

To ensure its processing of data is lawful, fair and transparent, the Coach shall maintain a Register of Systems.

The Register of Systems shall be reviewed at least annually.

Individuals have the right to access their personal data and any such requests made to the Coach shall be dealt with in a timely manner.
4. Lawful purposes

All data processed by the Coach must be done on one of the following lawful bases: consent, contract, legal obligation, vital interests, public task or legitimate interests.

The Coach shall note the appropriate lawful basis in the Register of Systems.

Where consent is relied upon as a lawful basis for processing data, evidence of opt-in consent shall be kept with the personal data.

Where communications are sent to individuals based on their consent, the option for the individual to revoke their consent should be clearly available and systems should be in place to ensure such revocation is reflected accurately in the Coach’s systems.
5. Data minimisation

The Coach shall ensure that personal data are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.
6. Accuracy

The Coach shall take reasonable steps to ensure personal data is accurate.

Where necessary for the lawful basis on which data is processed, steps shall be put in place to ensure that personal data is kept up to date.

7. Archiving / removal

To ensure that personal data is kept for no longer than necessary, the Coach shall put in place an archiving policy for each area in which personal data is processed and review this process annually.

The archiving policy : annual review of the Wix E-mail Subscription list and the permanent removal of the personal data on the un-subscribed list.
8. Security

The Coach shall ensure that personal data is stored securely using modern software that is kept-up-to-date.

Access to personal data shall be limited to Ann Desseyn -Cooper only and appropriate security should be in place to avoid unauthorised sharing of information.

The Coach does not allow the use of the database personal data for promotions or other purposes by external parties.

When personal data is deleted this should be done safely such that the data is irrecoverable.

Appropriate back-up and disaster recovery solutions shall be in place.
9. Breach
In the event of a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data, the Coach shall promptly assess the risk to people’s rights and freedoms and if appropriate report this breach to the ICO.

10. Trademark

The Love Gaelic logo's are registered trademarks and property of Love Gàidhlig Ltd and are an essential and valuable asset, and we are prepared to take all legal steps necessary to protect our interest and seek appropriate damages.

11. Warranty and Liability
​
Love Gàidhlig Ltd delivers services with professional diligence; however it is important to understand that Love Gàidhlig Ltd does not guarantee success or specific outcomes. Love Gàidhlig Ltd is not liable for advice or financial or economic loss. You acknowledge that results may differ from person to person and are dependent on many factors (like a person's background, level of dedication, and prevailing market environment).
Love Gàidhlig Ltd is also not liable for service failures due to Force Majeure and unauthorised actions by third parties (hacker attacks etc.)
Our liability shall be limited to the maximun extent permitted by law and confined to the total fees paid by you for services paid from us that are directly related to the claim.

12. Third Party Resources

Links to third party websites or resources do not imply any endorsement by or affiliation with Love Gàidhlig Ltd. You assume sole responsibility for and assume all risks arising from your use of any such websites or resources.

All notices, requests, demands and other communications under these Terms and Conditions shall be in writing and shall be made via e-mail and sent to info@lovegaidhlig.com

13. Electronic Communications

When you visit the site or send e-mails to Love Gàidhlig Ltd, you are communicating with us through electronic means. You grant your consent to receive such communications. We will mainly communicate with you by e-mail or by posting notices on the site. We transmit to you through means that satisfy any legal requirements that would apply if such communications were in writing.

14. Our Intellectual Property and Copyright

All our materials are protected by copyright, trademark or other intellectual property rights without the express written permission of the owner of the rights. The burden of determining whether Materials are protected rests entirely with you. You shall be liable for any damages resulting from any infringements of copyrights, trademarks, or other intellectual property rights, or any other harm resulting from such a submission. For all materials submitted to the site, you automatically warrant that you have the authority to use and distribute materials and that the use of display of the materials will not violete any laws, rules, regulations, or rights of third parties. In the event that Love Gàidhlig Ltd is held liable by a third party for infringement of any material submitted by you, you shall indemnify Love Gàidhlig Ltd in full. The indemnification includes the assumption of any legal fees incurred by Love Gàidhlig Ltd as well as any intervention in a dispute.

15. Your materials

We claim no intellectual property rights to materials you provide to Love Gàidhlig Ltd. You retain copyright and any other rights you may rightfully hold in any content that you submit through the site or service. By posting materials to us, you grant us a worldwide, non-exclusive, irrevocable licence to use the materials for promotional, business development, and marketing purposes. You also acknowledge that other Customers may use the material uploaded by you for their own purposes. In this case, you exempt Love Gàidhlig Ltd against any legal claims, but address your claims directly to the infringer.

16. Lawful purposes

Your account must not be used for illegal or unauthorized purposes, and you must comply with the laws of your jurisdiction and Scotland/UK when using our services. You are responsible for all purchases made by you or on your behalf through Love Gàidhlig Ltd. You agree to use our site and services and any other products for legitimate, non-infringing purposes only. You are prohibited from posting or transmitting any content through the Site that infringes on the rights of others or is unlawful.
17. Refund and Cancellation

All services, programs and products, including events, have their own refund policy on their sales pages or in the FAQ page. Please review these terms carefully before signing up.

18. Force Majeure
​
In the event of a delay or failure due to causes beyond our reasonable control, including but not limited to acts of God (Force Majeure), we will notify you as soon as practicable stating what has been cancelled or delayed. If a Force Majeure event continues for more than 60 days, we may terminate the contract with immediate effect. We are not liable for damages arising from non-delivery due to causes beyond our reasonable control.

19. Refusal of Services

We reserve the right to refuse services to anyone, at any time, for any reason, without explanation. An order is not considered accepted by us until payment has been processed. We may alter or discontinue any aspect of our services, fulfilling our previous commitments to you based on your payment.
